Photo/Video Terms and Conditions

By accepting these terms and conditions, you are hereby affirming that you are the copyright holder of the photograph(s) and/or video(s) and that your release of the photograph(s) and/or video(s) is voluntary, and that you acknowledge you will receive no financial compensation from the Seattle Southside Regional Tourism Authority, its contractors or its employees for use of the photograph(s) and/or video(s) to promote Seattle Southside and its attractions.

By accepting these terms and conditions, you are assigning the Seattle Southside Regional Tourism Authority the right to royalty-free, non-exclusive, perpetual use of photos or videos in any future, including but not limited to, publication, advertisement or promotion, whether in print, video, or digital format as the Seattle Southside Regional Tourism Authority sees fit. Seattle Southside Regional Tourism Authority may request a high-resolution, or original, version of the requested photograph or video. In providing the photograph(s)and/or video(s), you agree to these same terms and conditions.

You agree to defend, hold harmless and indemnify Seattle Southside Regional Tourism Authority, its officers, officials, agents, and employees from and against any and all claims, demands, actions, losses, damages, expenses, liabilities, or injuries, whether direct or indirect (including any and all costs and expenses, including attorney’s fees, in connection therewith), in connection with the grant or rights described herein and warranties given hereunder except for any such claim arising out of the sole negligence or willful misconduct of Seattle Southside Regional Tourism Authority, its officers, agents, employees or volunteers.

You hereby voluntarily waive any and all rights you may have to sue or otherwise pursue any action or claim against Seattle Southside Regional Tourism Authority related in any way, either directly or indirectly, to Seattle Southside Regional Tourism Authority’s use of the Content in accordance with these Terms and further waive any and all moral rights you may have in and to the Content.

Seattle Southside Regional Tourism Authority may, at its sole discretion, change these Terms and conditions at any time.

You understand and agree that the Content will be publicly displayed and it will not be treated as confidential. You further understand and agree that the Content and related information may be subject to release in response to a request under the Public Records Act and the content and related information may be subject to Seattle Southside Regional Tourism Authority’s records retention policies.

Nothing herein is intended to provide that the benefits of this Agreement shall inure to any third party, nor shall any provision herein be so construed.

Nothing herein shall be deemed, construed or represented by you, Seattle Southside Regional Tourism Authority, or any of its affiliates or by any third person to create the relationship of principal and agent between yourself and Seattle Southside Regional Tourism Authority, and you shall not, at any time, or in any manner, represent that you are in any manner an agent or employee of Seattle Southside Regional Tourism Authority. You understand and agree that you shall have no authority, expressed or implied, to act on behalf of Seattle Southside Regional Tourism Authority in any capacity whatsoever as an agent, nor shall you have any authority, expressed or implied, to bind Seattle Southside Regional Tourism Authority to any obligation whatsoever.
